Dr. Margaret Daley Carpenter of New Paltz is facing a $250,000 lawsuit filed by the state of Texas, which accuses her of prescribing abortion medication to patients within its borders.
Dr. Carpenter, who practices at Nightingale Medical in New Paltz and co-founded the Abortion Coalition for Telemedicine (ACT), allegedly prescribed the medications mifepristone and misoprostol to Texas residents through telehealth consultations. Texas officials contend that these actions violated state laws prohibiting individuals without a Texas medical license from providing medical care within the state, as well as restrictions on telehealth abortion services.
The legal complaint, filed in Collin County, Texas, also alleges that one of Carpenter’s patients required hospital treatment following complications from the prescribed medication. Texas is seeking an injunction to stop Carpenter from offering telehealth abortion services to its residents.
In response, New York leaders, including Attorney General Letitia James and Governor Kathy Hochul, have reaffirmed their support for medication abortion and shield laws designed to protect providers operating in states where abortion remains legal. The Abortion Coalition for Telemedicine has expressed concern that lawsuits like this undermine access to healthcare and jeopardize women’s health nationwide.
