Rich Lanzarone announced on Wednesday, November 27, that counsel representing his landlord advocacy not-for-profit, Hudson Valley Property Owner’s Association, Inc. (HVPOA), has filed paperwork to take his fight against rental stabilization in the City of Kingston to the New York State Court of Appeals in Albany, the highest court in the state. No further appeal is possible once the seven judges there make their decision.
Eight other LLCs and two individuals are also appellants. Lanzarone will retain the previous counsel provided by law firm Belkin, Burden and Goldman. Counsel alleges that “the lower courts committed errors in law” through rulings that failed to identify “deficiencies and manipulation in Kingston’s 2022 vacancy study.”
Lanzarone hopes his previous two defeats will be reversed in his final appeal.
